Regulations of using the City Hall of Olsztyn Internet Access-Point „WiFi zone”.

 

§1. General Principles

 

The following conditions determine the rules and the scope of using the network of access points in the IEEE 802.11b/g standard (further called Access Network) provided by the City Hall of Olsztyn (further called City Hall) for users (further called User or Users).

 
1. Using the Access Network is free. 

2. Before using the Access Network every User should acquaint themselves with the following Regulations.

3. Limitations for Users:

- one session cannot exceed 60 min,

- bandwidth is limited to 512 kbits per second

4. The City Hall of Olsztyn does not directly support Users with purchasing and configuration of WiFi adapters and is not responsible for the compatibility of User`s devices with the network.

 

§2. City Hall exemptions of  responsibility

 

1. City Hall is not responsible for temporary stales of signal or lower bandwidth of Access Network in designated areas.

2. City Hall is not responsible for unauthorized use of software or other intellectual property entities available on the Internet.

 3. City Hall is not responsible for damages of the User’s computer caused by the third-party software.

 4. City Hall is not responsible for delays and technical conditions of Access Network which may affect the real transfer.

5. City Hall is not responsible for the data collected or transferred by the User.

6. City Hall is not responsible for:

- loss of data or damage of User`s software,

- disclosure of User`s data,

- delays in receiving or transmitting data due to the lack of transmission, inappropriate transmission or  transmission gaps.

7. City Hall is not responsible for any loss caused by User’s hardware or software failures.

 

§3. User`s obligations

 

User uses Access Network on their own risk.

1. Logging into Access Network is equivalent to accepting the following Regulations.

2. User of Access Network is not allowed to:

- send or share content disallowed by the Polish law or content to which they have no intellectual property rights,

- send or share content which may violate personal goods of another person,

- send spam or other content not ordered by other users,

- transmit IP packets with a deliberately changed network address of the sender,

- try to get illegal access to IT resources of other users of the Access Network and the Internet,

- spread computer viruses or other software (spyware, malware and similar type) which may destroy the software or hardware of other computers on the Access Network and the Internet,

- resell Internet access without the knowledge and written consent of the City Hall,

- burden the bandwith through installing and sharing WWW, IRC, NNTP and other similar network content servers,

3. User is not allowed to use Access Network as the gateway to building their own solid network. Solid network is understood as every share of the Access Network to other computers for a period longer than two days in a month.

4. In case of breaking the Regulations by the User, the City Hall has the right to restrict or disable access to Access Network.

5. User is solely responsible (including legal responsibility) for their network activity.

6. User is solely responsible for any third-party activity caused by the use of the User’s authorization data.

7. User acknowledges that transmission in the Access Network is not encrypted.

8. User acknowledges the risk of using the unencrypted network access and is obliged to use all available network security tools to protect their computer (including firewalls, virus protection software, encryption of the transmission, backup and appropriate authorization)

9. User makes decisions about protection of their computer on their own risk.

 

§4. Fees

User can use the Access Network without any fees.

 

§5. Final resolutions

 

The City Hall reserves the right to modify these Regulations. User shall have no claim for it.

1. A current list of access points accessible for Users can be found on: www.olsztyn.eu

2. Any changes introduced become binding when published on: www.olsztyn.eu

3. In matters not regulated by these Regulations the Terms Of Telecommunication Services (Polish Law: Regulamin Świadczenia Usług Telekomunikacyjnych) and the Terms of Civil Code (Polish Law: Kodeks Cywilny) apply.

4. The following Regulations become binding on 19.04.2010.
